1. About benta.app
benta.app ("the Platform," "we," "us," or "our") is an e-commerce platform operated by Tempestra Information Technology Services (DTI-registered sole proprietorship)that enables Filipino small sellers ("Merchants") to create online stores and accept payments.
By accessing or using benta.app — including the dashboard, storefronts, and any associated APIs — you ("User," "Merchant," or "Customer") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
2. Eligibility
- You must be at least 18 years old to register as a Merchant.
- You must be legally authorized to operate a business in the Philippines, or be transacting on behalf of a business that is.
- By registering, you represent that all information you provide is accurate and complete.
- We reserve the right to refuse service to anyone for any reason not prohibited by applicable law.
3. Merchant Accounts
Registration
You must register for an account to use Merchant features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@benta.app if you suspect unauthorized access.
One account per store
Each account is tied to one primary store (tenant). Additional stores may be available on higher-tier plans. You may not share accounts or transfer accounts without our written approval.
Account termination
You may close your account at any time by contacting support. We may suspend or terminate accounts that violate these Terms, engage in fraud, or pose a risk to the Platform or other users.
4. Merchant Responsibilities
As a Merchant, you are solely responsible for:
- Your products and listings — ensuring they are accurately described, legally permitted to sell in the Philippines, and not prohibited under Section 6 below.
- Customer disputes — handling buyer complaints, returns, and refunds in good faith. benta.app is not a party to transactions between Merchants and Customers.
- Tax compliance — collecting and remitting any applicable taxes (VAT, percentage tax, etc.) as required by BIR regulations. benta.app does not collect or remit taxes on your behalf.
- Accurate pricing — maintaining accurate pricing and stock availability on your storefront.
- Data privacy— handling your customers' personal data in accordance with RA 10173 (Data Privacy Act). You act as an independent personal information controller for your customer data.
- Business permits and licenses — obtaining and maintaining all necessary government permits, DTI/SEC registrations, barangay clearances, and any product-specific licenses required for your business and the products you sell.
Logistics and Order Fulfilment
benta.app is a technology platform only. We do not provide shipping, courier, warehousing, or any logistics services. As a Merchant, you are entirely and solely responsible for:
- Selecting and contracting your own courier or logistics provider (e.g., LBC, J&T Express, Ninja Van, Lalamove, Grab Express, or any other service of your choice).
- Packaging, labelling, and dispatching orders to buyers.
- Providing accurate tracking information to buyers.
- Resolving lost, damaged, or delayed shipments directly with your chosen courier and with the buyer.
- Honouring the shipping fees and delivery timeframes stated on your storefront.
benta.app has no control over, and accepts no liability for, any act or omission by any courier or logistics provider used by a Merchant, or for any delivery failure, loss, or damage occurring after an order is dispatched.
Payment Collection and Disbursement
benta.app provides technology tools (payment forms, order tracking, receipt upload) that allow your buyers to complete purchases through your storefront. However, benta.app is not a payment service provider, payment aggregator, or escrow agent for Merchant–Customer transactions. As a Merchant, you are entirely responsible for:
- Setting up and maintaining your own payment accounts (GCash, Maya, bank transfer, PayMongo, Xendit, or any other method you enable).
- Receiving and reconciling payments from buyers directly into your own accounts.
- Issuing receipts or invoices to buyers as required by BIR regulations.
- Processing refunds to buyers from your own funds.
- Resolving payment disputes with buyers and, where applicable, with your payment gateway provider.
- Complying with BSP regulations on electronic money transfers and digital payments.
benta.app does not hold, receive, pool, or disburse funds on your behalf for Merchant–Customer transactions. All money from buyers goes directly to your designated accounts. Any integration with PayMongo or Xendit on your storefront is operated under your own merchant agreement with those providers.
5. Payments and Fees
Subscription plans
benta.app offers subscription plans (Free, Sulit, Starter, Growth, Pro) with different feature limits and monthly fees. Fees are billed monthly in Philippine Peso (PHP) and processed via PayMongo. Plans are as described on the upgrade page.
Transaction fees
The Free plan charges a platform transaction fee of 2% on each completed order. All paid plans (Sulit and above) have 0% platform transaction fees. Payment gateway fees charged by PayMongo or Xendit are separate and are borne by the Merchant.
AI credits
AI auto-fill credits are included monthly per plan tier. Additional credits may be purchased. Purchased credits do not expire and carry over month to month. Monthly included credits reset on the first day of each calendar month.
Refund policy
Subscription fees are non-refundable once a payment period has begun, except where required by applicable Philippine consumer protection law. AI credit packs are non-refundable once credits have been consumed. If you believe a charge was made in error, contact support@benta.app within 7 days.
Payment processing
Payments are processed by PayMongo and/or Xendit. You agree to their respective terms of service when completing a payment. benta.app is not responsible for payment processor downtime, declined transactions, or disputes initiated with the processor.

7. Intellectual Property
Your content
You retain ownership of all content you upload to benta.app (product photos, descriptions, store branding). By uploading content, you grant us a non-exclusive, royalty-free license to host, display, and process that content solely for the purpose of operating your store and the Platform.
Our platform
All software, design, trademarks, and content created by benta.app remain our exclusive intellectual property. You may not copy, modify, or distribute any part of the Platform without our written permission. The benta.app name and logo are our trademarks.
DMCA / Copyright
If you believe content on benta.app infringes your copyright, please send a takedown notice to support@benta.app with: (1) identification of the copyrighted work, (2) location of the infringing content on benta.app, (3) your contact information, and (4) a statement of good faith belief that the use is unauthorized.
8. Platform Role — Technology Provider Only
benta.app is a software-as-a-service (SaaS) platform, operating in a manner similar to Shopify or other hosted e-commerce platforms. We provide the technology tools — store builder, order management, product catalogue, payment form integrations, and related features — that allow independent Filipino sellers to run their own online stores.
benta.app is not a retailer, marketplace operator, seller, buyer, courier, logistics provider, payment service provider, escrow service, or financial institution. We do not buy or sell any goods. We do not hold or transfer money between buyers and sellers. We do not ship or deliver any products.
Merchant–Customer Transactions
Every transaction on a benta.app-powered storefront is a direct, independent transaction between the Merchant and their Customer. benta.app is not a party to that transaction and assumes no liability for:
- The quality, safety, legality, accuracy of description, or fitness for purpose of any product listed by a Merchant
- A Merchant's failure to deliver, deliver on time, or deliver as described
- A Merchant's failure to honour their return, refund, or exchange policy
- Any loss, damage, or injury arising from a product sold by a Merchant
- Disputes between a Merchant and a Customer
Customers who purchase from any store on benta.app are contracting with the individual Merchant, not with benta.app. Customers should direct all post-purchase concerns (delivery issues, returns, refunds) to the Merchant directly.
No Logistics or Delivery Responsibility
benta.app does not arrange, contract, or provide shipping, delivery, or courier services. All logistics are arranged independently by the Merchant. benta.app has no visibility into, control over, or liability for:
- Whether a Merchant dispatches an order
- The courier or logistics provider a Merchant chooses
- Delivery timeframes, delays, or failures
- Lost, stolen, or damaged parcels during transit
Claims arising from delivery failures must be directed to the Merchant and, where applicable, to the courier. benta.app is not a proper party in such claims.
No Payment Holding or Disbursement
benta.app does not collect, hold, pool, or disburse Customer payments on behalf of Merchants. When a buyer pays via GCash, Maya, bank transfer, COD, or any other method enabled on a Merchant's storefront:
- The funds go directly to the Merchant's own payment account (GCash number, bank account, PayMongo sub-merchant account, etc.).
- benta.app receives no portion of the transaction amount (except its own separately billed platform subscription fee).
- benta.app has no ability to freeze, reverse, or refund a buyer's payment on a Merchant's behalf.
Any dispute about a payment — whether it was received, whether a refund was issued — must be resolved between the Merchant and the Customer. If a payment processor (PayMongo, Xendit, GCash, Maya) is involved, the Merchant must engage that provider directly under their own merchant agreement.
9. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that the results obtained from using the Platform will be accurate or reliable.
10. Limitation of Liability
To the maximum extent permitted by Philippine law, benta.app shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform, including but not limited to: loss of profits, loss of data, business interruption, or loss of goodwill.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid us in the 3 months preceding the claim, or (b) ₱1,000.
11. Indemnification
You agree to indemnify and hold harmless benta.app, its operators, and affiliates from any claims, losses, damages, liabilities, costs, or expenses (including attorney's fees) arising out of: (a) your use of the Platform; (b) your products or services; (c) your violation of these Terms; or (d) your infringement of any third-party rights.
12. Governing Law and Disputes
These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the jurisdiction of the appropriate courts of the Philippines.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email to registered Merchants at least 14 days before taking effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
The current version is always available at https://benta.app/terms.
